Scope
These Terms of Sale govern every order placed on this website with Bioshop L.L.C., a limited liability company organised under the laws of the State of New Mexico, United States, whose details appear in our Legal Notice. Placing an order implies full acceptance of these terms as published on the day of the order.
They apply to consumers and to professional buyers alike, it being understood that the mandatory consumer protections described below benefit consumers only.
Products
We sell food supplements. They are not medicinal products, and they are not intended to diagnose, treat, cure or prevent any disease. Read our Health Disclaimer before ordering, particularly if you are pregnant or breastfeeding, take medication or have a medical condition.
Product images on this website are illustrative renderings of packaging design, not photographs of the item you will receive. Composition, format and labelling may change. The label on the product as delivered always prevails.
Prices
Prices are shown in euros (EUR) or United States dollars (USD) according to the currency you select. The price applicable to your order is the one displayed at the moment the order is placed. We may change prices at any time, without effect on orders already placed.
Displayed prices exclude shipping, which is added before payment. Any applicable sales tax or VAT is calculated and shown at the payment stage. For deliveries outside the country of dispatch, customs duties and import charges may be levied by the destination country and remain payable by the recipient.
Placing an order
You select your products, review your basket, and are then directed to a secure payment page. Before paying you can check the contents of your basket, the total and the shipping cost, and correct any error by returning to the basket.
How payment works here. Each product is paid for through its own secure payment page. An order containing several different products is therefore settled in several payments, one per product. You choose the quantity on the payment page.
A sale is formed only once payment is confirmed. You then receive a confirmation by email summarising the order. We recommend that you keep it.
Payment
Payment is processed by Stripe, an independent payment service provider, on a secure page hosted by Stripe. Accepted methods are those shown on that page, typically major payment cards and supported wallets.
Bioshop L.L.C. does not collect, see or store your card number or security code at any point. Payment is taken when the order is placed.
Availability
Our offers are valid while stocks last. If a product turns out to be unavailable after your order, we will inform you without delay and refund the corresponding amount in full, using the same payment method, within fourteen days at the latest.
Delivery
We deliver to the addresses listed at the payment stage. Indicative timeframes run from dispatch:
- European Union — 3 to 7 working days;
- United States — 3 to 6 working days;
- rest of the world — 7 to 15 working days.
Shipping is free above the threshold shown in your basket; below it, a flat rate applies. These timeframes are indicative and do not constitute a guaranteed delivery date. Where you are a consumer, risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, take physical possession of the goods.
If a parcel arrives damaged, note it with the carrier on receipt and tell us within three working days so that we can act.
Right of withdrawal
If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, you have fourteen days from the day you receive the goods to withdraw from the sale, without giving any reason and without penalty.
Important exception for supplements. The right of withdrawal cannot be exercised on sealed goods that are unsuitable for return for health-protection or hygiene reasons once they have been unsealed after delivery — Article 16(e) of Directive 2011/83/EU, and Article L221-28, 4° of the French Consumer Code. In practice: an unopened product with its seal intact may be returned; an opened product may not.
To withdraw, write to info@bioshopessentials.com with your order reference and an unambiguous statement of your decision, before the fourteen-day period ends. You then have fourteen days to return the goods; direct return costs are borne by you.
We refund all sums received, including standard outbound delivery costs, no later than fourteen days after we are informed of your decision, and we may withhold the refund until we have received the goods back or you have supplied proof of dispatch.
Legal warranties
Consumers benefit from the mandatory legal warranties of the law of their country of residence, whatever these terms say. In France, these are the legal guarantee of conformity (Articles L217-3 and following of the Consumer Code, two years from delivery) and the guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code).
Under the guarantee of conformity you may ask for the goods to be brought into conformity, or failing that for a price reduction or rescission of the sale. No proof of the defect is required during the first two years. To make a claim, write to us at the address above.
Returns and refunds
Contact us before returning anything, so that we can give you return instructions. Products must be returned complete and, save in the case of a defect, unopened with their seal intact. Refunds are issued to the original payment method.
Liability
Bioshop L.L.C. is liable for the proper performance of the contract under the applicable law. We are not liable for consequences arising from use of a product contrary to the instructions on its label, from an undeclared allergy or intolerance, or from an interaction with a medical treatment about which no healthcare professional was consulted.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded, including liability for defective products.
Complaints and dispute resolution
Write to us first at info@bioshopessentials.com: most matters are settled quickly this way.
If a consumer dispute remains unresolved, a consumer resident in France may refer the matter free of charge to a consumer ombudsman (médiateur de la consommation) under Article L612-1 of the Consumer Code. Consumers elsewhere in the European Union may use the approved alternative dispute resolution body of their country. The European Commission's online dispute resolution platform ceased operating in July 2025 and is no longer available.
Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules, and the courts of Bernalillo County, New Mexico have jurisdiction. This choice does not deprive a consumer of the protection of the mandatory provisions of the law of their country of residence, nor of the right to bring proceedings before the courts of that country.
Intellectual property and site use
The site and its content — text, layout, graphics, imagery, logos and the Bioshop name — belong to Bioshop L.L.C. or are used under licence. You may view and print pages for personal, non-commercial use. Any other reproduction, distribution, modification or commercial exploitation requires our prior written consent. You agree not to use the site unlawfully, to attempt unauthorised access, or to scrape its content by automated means.
Changes and severability
We may amend these terms at any time. The version applicable to an order is the one published when that order is placed. If any provision is held invalid, the remaining provisions continue in force.
